FAN ART AND IDEAS SUBMISSION POLICY
Epic Fun Studios ("the Studio," "we," or "us") is incredibly grateful for the support of our players. We love seeing the passion of our community, whether it is through creating artwork based on our games or sharing exciting new ideas for our future updates.
At the same time, we have invested significant time, effort, and resources into creating our intellectual property and must take strict measures to protect it. Please read this Fan Art & Idea Submission Policy ("Policy") carefully because it affects your legal rights and obligations. By submitting Fan Art or Submissions (defined below) to us, you fully understand and accept this Policy, as well as our Terms of Service, as a legally binding agreement. We may revise this Policy from time to time by updating this posting, and your continued submission of content constitutes your acceptance of those revisions.
1. FAN ART SUBMISSIONS
For the purposes of this Policy, any drawings, illustrations, graphic representations, or similar creative works based on our intellectual property that you create and share with us shall be deemed "Fan Art".
2. OWNERSHIP AND RIGHTS
All title, ownership, and intellectual property rights in and to the games produced by Epic Fun Studios are the sole property of the Studio and its affiliates. This includes, but is not limited to, computer code, themes, objects, characters, names, stories, dialog, catchphrases, locations, artwork, animations, sounds, musical compositions, audiovisual effects, and moral rights (collectively, the "Studio IP").
The Studio IP is protected by United States copyright laws, international treaties, and other applicable laws. THIS POLICY GRANTS NO LICENSE TO THE STUDIO IP TO ANY PARTY, AND NOTHING IN THIS POLICY SHOULD BE CONSTRUED TO GRANT ANY FORM OF LICENSE TO THE STUDIO IP.
3. YOUR LICENSE TO US (FAN ART)
In consideration of the Studio providing you the opportunity to participate in our community and share Fan Art, you hereby grant Epic Fun Studios a non-exclusive, worldwide, royalty-free, perpetual license to use, display, modify, and exploit your Fan Art. This means we can use your submitted Fan Art for our business purposes in all media now known or hereafter devised, including but not limited to the right to use it on our websites, social media, community channels, and for internal, trade, and advertising purposes, without any compensation to you.
4. FAN ART RESTRICTIONS
If you create Fan Art, you must strictly adhere to the following rules:
-
Keep it Appropriate: Fan Art must be appropriate for our game's audience and consistent with the spirit and tone of the Studio IP. It must comply with applicable laws and must not be obscene, sexually explicit, defamatory, offensive, or harmful to others.
-
No Commercial Use: Your Fan Art must have no commercial (i.e., monetary) objective. You may not sell or monetize it.
-
No Endorsements: You may not state or imply that your Fan Art is officially endorsed or approved by Epic Fun Studios.
-
No Cheats/Hacks: Fan Art may not include links to websites that promote exploits, hacks, or the unauthorized selling of in-game assets.
-
No Official Confusion: You may not create or use Fan Art in a manner that could cause people to believe it is an official Epic Fun Studios production.
-
Protect the Brand: You may not use our IP in a manner that is derogatory or that may damage the value, reputation, or goodwill of the Studio or its products.
-
No Trademark Misuse: You may not use Epic Fun Studios' official logos or trademarked game titles in your Fan Art at any time. All rights to our trademarks are expressly reserved.
Any display of your Fan Art outside of our official community channels (such as our Discord server) must display the following disclaimer:
"This material is not official and is not endorsed by Epic Fun Studios. All rights reserved by Epic Fun Studios."
We reserve the right, in our sole discretion, to remove your Fan Art or revoke your access to our community channels at any time and for any reason.
5. IDEA SUBMISSION AND ASSIGNMENT OF RIGHTS
Epic Fun Studios actively engages with its community and welcomes feedback, suggestions, concepts, game mechanics, feature requests, and other ideas (collectively, "Submissions"). However, to prevent future legal disputes regarding intellectual property ownership, all Submissions are governed strictly by the following terms:

a. Irrevocable Assignment and License: By transmitting, posting, communicating, or otherwise providing any Submission to the Studio, you hereby irrevocably and in perpetuity assign, transfer, and convey to the Studio all right, title, and interest in and to the Submission, including any and all copyrights, trademarks, patents, trade secrets, and other intellectual property rights therein, throughout the universe. To the extent such assignment is deemed invalid or unenforceable under applicable law, you hereby grant the Studio an exclusive, perpetual, irrevocable, worldwide, fully paid-up, royalty-free, sublicensable (through multiple tiers), and transferable license to reproduce, distribute, modify, create derivative works of, publicly display, commercialize, and otherwise exploit the Submission in any media now known or hereafter devised.

b. Waiver of Moral Rights and Claims: To the maximum extent permitted by law, you hereby absolutely and irrevocably waive any and all "moral rights" (droit moral), rights of attribution, rights of integrity, or similar rights you may have in the Submission under the laws of any jurisdiction. You further agree to irrevocably waive, release, and hold harmless the Studio, its affiliates, successors, assigns, and licensees from any claims, demands, or causes of action arising out of or related to the Studio's use, non-use, modification, or exploitation of the Submission, including but not limited to claims for misappropriation, infringement, breach of implied contract, or unjust enrichment.

c. No Compensation or Fiduciary Duty: You expressly acknowledge and agree that your Submission is provided voluntarily, on a non-confidential basis, and without any expectation of compensation, royalty, attribution, or consideration of any kind. No confidential, fiduciary, agency, partnership, or implied-in-fact contract relationship is created between you and the Studio by your provision of any Submission.

d. Independent Development and Coincidental Similarities: You acknowledge that the Studio is continually developing its own ideas, games, and features, and may already possess, receive from third parties, or independently develop materials that are subjectively or objectively similar or identical to your Submission. You agree that the Studio assumes no obligation to compensate or credit you for the use of any elements, concepts, or ideas similar to those contained in your Submission.
