INTRODUCTION

This Privacy Policy ("Policy") describes the data processing activities of Epic Fun Studios (collectively, "we," "us," or the "Developer"). This Policy applies to the games developed by the Developer ("Games"), our website at www.epicfunstudios.com, and any other associated services we offer (collectively, the "Services").

This Policy explains what information we collect from users who access the Services and their parents or legal guardians ("users" or "you"), why we collect it, and how we use it. By using our Services, you consent to this Policy and the processing of your data. If you do not agree with these terms, please do not use the Services.

CHANGES TO THIS POLICY

We reserve the right to update or modify this Privacy Policy at our discretion. If we make material changes, we will provide notice by announcing the updates within the Services or on our website. Your continued use of the Services after such notice constitutes your acceptance of the updated Policy. Information collected will be handled in accordance with the Policy version in effect at the time of collection.​

 

THE GAMES

Our Games are hosted and operate exclusively on the online platform managed by Roblox Corporation ("Roblox"). To access and play our Games, you must have a registered account on the Roblox website (https://www.roblox.com).

Because our Games run on this platform, Roblox's data practices apply whenever you or your child access our Games. We do not control and are not responsible for Roblox’s data collection or processing activities. We strongly encourage you to review the Roblox Privacy Policy to understand how they handle your data globally.

CHILDREN

For any child under 13 (or under 16 in certain jurisdictions), Roblox automatically restricts their account settings to "Privacy Mode." This mode limits access to certain features on the Roblox platform, which may also restrict access to certain features within our Games.

COMMITMENT TO CHILD PRIVACY

  • No Direct Collection via Games: We do not knowingly collect or process personal contact information (such as real names, physical addresses, or email addresses) from children under 13 (or 16 in applicable jurisdictions) through their interaction with our Games.

  • Limited Exception for Program Applicants: We only collect personal identifiers (such as email addresses or birthdays) when voluntarily submitted by users who are at least 13 years of age specifically for the purpose of applying to our Influencer or Moderator Programs. Any application discovered to be submitted by a child under the age of 13 will be immediately deleted, and no data from such an application will be retained.

  • Data Minimization: We do not collect any more information than is reasonably necessary for users to participate in the Services (such as saving in-game progress).

  • Removal Requests: If you believe we have inadvertently collected personal information from your child, please contact us immediately. We will take reasonable measures to delete the applicable data from our internal game data stores, subject to the technical capabilities of the Roblox platform.

NOTICE AT COLLECTION - INFORMATION WE COLLECT

To provide users with the best possible experience, we may collect certain personally identifiable information ("Personal Information"). Personal Information is any information that can be used to identify you or your household or to contact you, whether online or offline. It can include things like name, email addresses, online usernames, and any data that can be linked to such identifiers.

PLEASE NOTE THAT THE INFORMATION DESCRIBED IN SECTIONS (c) AND (d) BELOW MAY NOT BE COLLECTED BY THE GAMES AND THE GAMES ONLY COLLECT THE INFORMATION DESCRIBED IN SECTIONS (a) AND (b).

A. INFORMATION COLLECTED DURING GAMEPLAY

The Services may collect Personal Information when you play the Games. The categories of Personal Information we collect from you when you play the Games are as follows:

  • ​Identifiers: Your Roblox User ID, username and display name. Processing this information is necessary to allow you to access the Games. Processing this information is necessary to allow us to record in-Game purchase and to ensure Roblox provides you with any items you may have purchased.

  • Personal Information as defined by California Civil Code §1798.80(e): Your Roblox ID. Processing this information is necessary to allow you to access and use the Games.

  • Commercial Information: In-Game purchase data. Processing this information is necessary to allow us to record in-Game purchase and to ensure Roblox provides you with any items you may have purchased.

  • Geolocation DataYour Country of origin. Please note, the Games do not collect information regarding precise geolocation, physical address, zip code, city, or state. Your country of origin may be visible by other Players during the Games. Collecting this information is necessary to provide us with analytics to improve our Services.

  • Internet or electronic network activity information: Your Usage data with respect to your use of the Games including acquired items, how much time you spend in the Games and in what locations, in-Game interactions, Gameplay data, gifts, and Roblox usage data, including crashes, timestamps and other records and data regarding in-Game activity. We process this information to create analytics regarding Gameplay to improve the Gameplay experience. We also process this information to monitor the Games and enforce our terms of service (“TOS”) and other guidelines.

B. INFORMATION THE GAMES MAY  COLLECT AUTOMATICALLY

The Games also collect device-identifiable information ('DII') to allow us to identify the type of device on which you are playing the Games. Please note the information provided in Sections (a) and (b) represent the full extent of the Personal Information collected by the Games.

C. INFORMATION WE COLLECT VIA YOUR USE OF OTHER SERVICES OR WHEN YOU VISIT OUR WEBSITE

When you interact with our website, we may automatically collect usage information, such as your navigation paths and the specific Services or features you access, to optimize your experience. We also collect Personal Information that you voluntarily provide when you use our Services, submit a job application or resume, contact us for support, or engage with us through social media and our authorized partners. If you reach out to us, we may maintain a record of that communication and any associated data described in this Policy to effectively resolve your inquiry. Furthermore, if you provide an email address through our website, we may use it to share updates or information regarding our Services. The categories of Personal Information we collect from you through these other Services are as follows:

  • Identifiers: Name, alias, physical address, phone number, IP address, email address, Roblox ID, Discord ID, social media handles, or similar account names. We process this to grant access to the Services, respond to inquiries, and communicate with you (including for our Influencer Program). We use IP addresses to generate analytics to improve the Services, monitor activity, enforce our Terms of Service, prevent fraud/abuse, and ensure security.

  • Personal Information as defined by California Civil Code §1798.80(e): Information capable of being associated with you or your household, including legal name, date of birth, country of origin, physical address, and the identifiers listed above. We process this to grant access to the Services, respond to inquiries, and communicate with you (including for our Influencer Program). We use IP addresses to generate analytics to improve the Services, monitor activity, enforce our Terms of Service, prevent fraud/abuse, and ensure security. For prospective employees or contractors, this is also used to verify identity, send correspondence, and process payments.

  • Internet or electronic network activity information: Including, but not limited to browsing history, page views, search history, and data regarding your interactions with or referrals to our websites. We process this to generate analytics to improve the user experience, monitor activity, enforce our TOS, prevent fraud, spam, and abuse, and ensure the security of the Services.

  • Professional or employment related Information provided pursuant to a job application or other professional inquiry: Information provided during a job application or professional inquiry (e.g., education, employment history, compensation history). We process this to evaluate your employment, contractor, or Influencer Program application.

 

D. INFORMATION THE SERVICES MAY COLLECT AUTOMATICALLY WHEN YOU VISIT OUR WEBSITES​

When you use our websites and external Services (excluding the Games), we may automatically create or collect Device-Identifiable Information ('DII'). This includes unique device identifiers, statistical identifiers, and similar data linkable to your browser or device.

  • Device & Connection Data: We may receive information from your device such as your IP address, user agent, timestamps, precise and imprecise geolocation, sensor data, installed apps, fonts, battery life information, and screen size.

  • Interaction Data: Our websites collect data regarding your interactions, including navigation paths, search queries, crashes, timestamps, purchases, clicks, shares, and referral URLs.

  • Data Combination & Transmission: We may combine this automatically collected interaction data with your Personal Information and DII. For efficiency and performance, information about your interactions may be transmitted to our servers even while you are not actively interacting with the Services.

We use the Personal Information gathered through our Services to provide, maintain, protect, and improve our current offerings, to develop new Services, and to safeguard both the Developer and our users. With respect to the Games, we specifically use your Personal Information to operate the Games and to enhance your overall gameplay experience.

In addition to these general uses, we process your Personal Information for the following specific business purposes:

SERVICE DELIVERY AND SUPPORT

  • Fulfilling Requests: To meet the specific reason for which the information was provided.

  • Communication: To provide information or services you request and to communicate with you upon your request.

  • Technical Support: To resolve technical issues or other challenges you may encounter while using the Services.

  • Performance Optimization: To improve the Games, the Services, and the performance of all associated content.

PROGRAM MANAGEMENT

  • Content Creator Program: To oversee and manage our Content Creator Program. This includes collecting your birth date to verify you meet the minimum age requirement (13+), and processing your email, Roblox ID, and content portfolios to evaluate your application and maintain contact.

  • Discord Moderator Program: To manage our community moderation team. This includes collecting your birth date to verify age eligibility (13+), and processing your Discord ID, Username, and contact information to evaluate your application and facilitate internal communication.

LEGAL, SECURITY AND EMPLOYMENT

  • Safety & Fraud Prevention: To detect and prevent potentially fraudulent, prohibited, or illegal activities.

  • Dispute Resolution: To resolve legal or user disputes and enforce our Terms of Service (TOS).

  • Legal Compliance: To perform other duties as required by applicable laws or regulatory authorities.

  • Employment & Contracting: To support our internal operations, including soliciting and processing job applications, managing our team, and providing compensation and benefits to employees or contractors.

NOTICE AT COLLECTION - HOW WE DISCLOSE PERSONAL INFORMATION TO THIRD PARTIES

WE DO NOT SELL, LEASE, SHARE, OR OTHERWISE TRANSFER YOUR PERSONAL INFORMATION TO THIRD PARTIES FOR THEIR OWN USE OR FOR THE PURPOSE OF CROSS-CONTEXTUAL BEHAVIORAL ADVERTISING. SIMILARLY, WE DO NOT SELL, LEASE, SHARE, OR OTHERWISE TRANSFER THE PERSONAL INFORMATION OF ANYONE UNDER THE AGE OF 16. WE DO NOT PROCESS OR OTHERWISE COLLECT ANY SENSITIVE PERSONAL INFORMATION, BIOMETRIC DATA, OR DATA GENERATED BY AUTOMATED BIOLOGICAL MEASUREMENTS.

While we do not sell your data, we may transfer Personal Information and DII to third-party companies, service providers, or individuals for the following limited business purposes:

HOW LONG YOUR PERSONAL INFORMATION WILL BE STORED

  • Professional Evaluation: We process information provided via job applications or professional inquiries to evaluate potential employment or business relationships.

  • Data Integrity: We process all described Personal Information to create and maintain secure backups, guarding against data loss or breaches.

This Policy applies solely to the Services operated by the Developer. It does not apply to services, products, or websites offered by third parties, including those linked through our Services. Please note: We may deny a deletion request if retaining the information is necessary for legitimate business purposes or to comply with legal obligations.

We strongly recommend that you take proactive steps to protect your data, such as enabling two-factor authentication (2FA) on your Roblox and social media accounts, using strong passwords, and logging off from the Services when using shared devices.

INTERNATIONAL TRANSFERS

Our Services are managed from the United States, and your Personal Information may be transferred to or stored in jurisdictions where data protection laws differ from those in your home country. By using our Services, you authorize the Developer to process your information in the United States or any other location where we or our service providers operate.

We utilize recognized legal mechanisms to ensure the lawful transfer of data across borders. This includes ensuring our processors adhere to the Standard Contractual Clauses (SCCs) as approved by the European Commission. We will only transfer Personal Information across jurisdictions if:

  • You have provided explicit consent;

  • The transfer is necessary to complete a transaction or fulfill a contractual obligation;

  • The recipient is subject to laws or contractual obligations that provide a level of protection substantially similar to the standards of the EU, UK, or Switzerland; or
